Cell Phone Restrictions

The Federal Motor Carrier Safety Admiration (FMCSA) has issued the final rule on cell phone usage while driving a Commercial Motor Vehicle. The current rule will go into effect on Friday December 30, 2011.

The new rule prohibits the use of all mobile handheld devices while the Commercial Motor Vehicle is moving. This includes cell phones, push to talk devices, texting, and emailing. The rule specifically prohibits a CMV driver from holding, reaching, dialing, or texting from a cell phone. A hands-free phone is allowed, as is the use of CB radios and two-way radios. However, use of any of these devices must comply with the FMCSA rule. A wired or wireless device is acceptable as long as it can be answered using the above criteria.

The fine for violations of this policy is significant. The diver can be fined up to $2,750.00 for each offense.

A new Fleetwood cell phone policy will be issued in a few days and will be communicated to all drivers, contractors, supervisors, and employees.
